Privacy Policy 

This is the Privacy Policy of the Storymakery™ website and any mobile or other apps that we provide (together, the "Site"), operated by Pastiche Ventures, LLC. ("Storymakery", "us", "our" and "we" and terms of similar meaning). It describes the information that we collect from you as part of the normal operation of our Site, and how we use and disclose that information.

By accepting the Privacy Policy in registration or by visiting and using the Site, you expressly consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to our {Terms of Service}.

In this Privacy Policy, we use the term "Member" to describe a registered user of the Site. Together with Members, people who browse our Site without becoming Members are called "Users" of our Site.

What Information Do We Collect?

Our goal in collecting personal information from you is to provide you with a convenient, efficient and personalized experience. In order to maintain customer satisfaction, this information will be used to meet expectations on product orders, provide a unique experience and deliver a high level of customer service.  However, we also want your experience to be safe. We only collect personal information about you that we consider necessary for achieving this purpose.

In general, you can browse the Site without telling us who you are or revealing any personal information about yourself. Once you become a Member, we require you to provide various contact and personal information as indicated on the relevant forms on the Site, and you are no longer anonymous to us. Where possible, on these forms we indicate which fields are required and which fields are optional. You always have the option to not provide information by choosing not to become a Member or by not using the particular feature of the Site for which the information is being collected. If you choose to include personal information in your storybooks and posters we collect that information as well.

We also automatically track certain information about you based upon your behavior on our Site. We may use this information to do internal research on our users' demographics, interests, and behavior to better understand, protect and serve you and our community. This information may include the URL that you just came from (whether this URL is on our Site or not), which URL you next go to (whether this URL is on our Site or not), your computer browser information, and your IP address.

"Cookies" are small files placed on your hard drive that assist us in providing our services. Cookies will be used on the Site to allow you to enter your password less frequently during a session, to help us with data collection on the Site to help analyze our web page flow, measure promotional effectiveness, and promote trust and safety, to offer certain features that are only available through the use of a cookie and to allow us to provide information that is targeted to your interests. If you have cookies disabled in your browser you may not be able to use the Site.

If you send us personal correspondence, such as support or other emails or letters, or if other users or third parties send us correspondence about your activities on the Site, we may collect such information into a file specific to you.

Following your registration on the Site, you can review and change your information in your account area. If you disclose personal information in any public area of the Site and wish to have it removed, please contact us with the support contact information posted on the Site.

What do we do with the collected information?

We use personal information in the file we maintain about you, and other information we obtain from your current and past activities on the Site, to provide to you the services offered by the Site; resolve disputes; troubleshoot problems; measure consumer interest in our products and services, inform you about online and offline offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our {Terms of Service}.; and as otherwise described to you at the time of collection, use or disclosure. We may compare and review your personal information for errors, omissions and for accuracy. We may also use personal information about you to improve our marketing and promotional efforts, to analyze Site usage, to improve our content and product offerings, and to customize the Site's content, layout, and services. These uses improve the Site and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe and customized experience while using the Site.

We may also use your personal information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as Storymakery promotions, administrative notices, product offerings, and communications relevant to your use of the Site. If you do not wish to receive these communications, you can opt out of the receipt of certain communications by sending us an email at Communications@Storymakery.com. You may make changes to your account preferences at any time.

Our Disclosure of Your Information

We will not sell or rent any of your personal information to third parties without your explicit consent. The following describes some of the ways that your personal information may be disclosed in the normal scope of business to provide our services.

Stories. In the normal operation of the Site, if you choose to make a story public, your alias (username) and character will appear on the Site when you post your Stories, together with other information you include in your Stories. Any personal information you include in your Stories may be disclosed to them as well. However, during the storybook creation process, we provide reminders to not use actual names.

 

Photo. Should you choose to make your author photo a photo of yourself, this photo will appear on the Site when you post your Stories or make comments.

 

Comments. If you post comments on a Storymakery comments page or through an app, your username and character will appear on the Site and is therefore available to the public. Any additional personal information you include in your comments will appear on the Site and be available to the public as well.

 

Legal Requests; Emergencies. We cooperate with law enforcement inquiries and demands for information that are made under force of law. Therefore, we may provide personal information to law enforcement agencies in what we believe to be emergency situations, we may provide personal information where we have a good-faith belief that we are required to do so by statute, court order, legal process or lawful authority, and we may provide it to our legal counsel in connection with the foregoing. We may also disclose personal information to third parties if we believe, in good faith, that disclosure is appropriate or necessary to enforce our Terms of Service, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our Site, and to protect the rights, property, or personal safety of Storymakery, our users or others. In some cases, personal information that we collect may be stored or processed outside of the United States, and may therefore be subject to the legal jurisdiction of those countries.

 

Sale or Financing. If Storymakery becomes involved in a proposed amalgamation or sale of some or all of its assets, or if its owners propose to sell their interest in the company, or in the course of a proposed financing, we may disclose personal information to the proposed acquirers or investors, and their advisors, as part of their due diligence investigations of the Company or upon the completion of the applicable transaction. Any such disclosure will be pursuant to confidentiality agreements customary for such transactions.

Children’s Online Privacy Protection Act

Storymakery™ is committed to protecting the privacy of children who use our site and application. This Children’s Online Privacy Policy explains our information collection, disclosure, and parental consent practices with respect to information provided by children under the age of 13 (“child” or “children”), and uses terms that are defined in our general Privacy Policy. This policy is in accordance with the U.S. Children’s Online Privacy Protection Act (“COPPA”), and outlines our practices in the United States regarding children’s personal information. 1. What Information is Collected and How it is Used

Storymakery is a website application whose primary audience is children and families. Our site includes character creation and storytelling activities that may collect information from children. Below we summarize potential instances of collection and outline how and when we will provide parental notice and/or seek parental consent. In any instance that we collect personal information from a child, we will retain that information only so long as reasonably necessary to fulfill the activity request or allow the child to continue to participate in the activity, and ensure the security of our users and our services, or as required by law. In the event we discover we have collected information from a child in a manner inconsistent with COPPA’s requirements, we will either delete the information or immediately seek the parent’s consent for that collection.

Registration

Children can register as a Member of our site to create characters, create storybooks, create posters and may in the future participate in contests or engage in special features. During the registration process, we ask users provide certain information for notification and security purposes, including a parent or guardian’s email address, a username (using an alias), and password. We strongly advise children never to provide any personal information (e.g. actual name) in their usernames. Please note that children can choose whether to share their information with us, but certain features cannot function without it. As a result, children may not be able to access certain features if required information has not been provided.

Consistent with the requirements of COPPA, on any child-targeted site or application, or in any instance where we ask for age and determine the user is age 12 or under, we ask for a parent or guardian email address before we collect any personal information from the child.  If you believe your child is participating in an activity that collects personal information and you or another parent/guardian have NOT received an email providing notice or seeking your consent, please feel free to contact us at info@storymakery.com. We will not use parent emails provided for parental consent purposes to market to the parent, unless the parent has expressly opted in to email marketing or has separately participated in an activity that allows for such email contact.

Birthdates

We will ask for birth dates from users only to validate their ages before entering a purchasing area on the website. 

Content Generated by a Child

Activities on our site allow children to create or manipulate content and save it with STORYMAKERY.  Some of these activities do not require children to provide any personal information and therefore may not result in notice to the parent or require parental consent. Storymakery will review any published content such as storybooks.  If there is information that does not meet COPPA laws, the content will immediately be made private and an email will be sent to the parent/guardian.  Examples of created content that may include personal information are stories or other open-text fields such as Author Bio and Dedication pages.  The web application provides guidelines to not disclose personal information such as actual names of relatives, actual name of author, address and other interests that can make the child identifiable.  If, in addition to collecting content that includes personal information, Storymakery also plans to post the content publicly or share it with a third party for the third party’s own use, we will obtain a higher level of parental consent.

About Verifiable Parental Consent:

Email Consent. In the event Storymakery wishes to collect personal information from a child, COPPA requires that we first seek a parent or guardian’s consent by email. In the email we will explain what information we are collecting, how we plan to use it, how the parent can provide consent, and how the parent can revoke consent. If we do not receive parental consent within a reasonable time, we will delete the parent contact information and any other information collected from the child in connection with that activity.

High-Level Consent. In the event Storymakery collects personal information from a child that will be posted publicly, we will seek a higher level of consent than email consent. Such “high-level” methods of consent include but are not limited to:

·         Providing a consent form to be signed by the parent and returned via U.S. mail, fax, or electronic scan;

·         Requiring the parent, in connection with a monetary transaction, to use a credit card, debit card, or other online payment system that provides notification of each discrete transaction to the primary account holder;

·         Having the parent call a toll-free telephone number staffed by trained personnel, or have the parent connect to trained personnel via video-conference; or

·         Verifying a parent’s identity by checking a form of government-issued identification against databases of such information, provided that you promptly delete the parent’s identification after completing the verification.

Teacher consent in lieu of a parent. With regard to school-based activities, COPPA allows teachers and school administrators to act in the stead of parents to provide consent for the collection of personal information from children. Schools should always notify parents about these activities. Contests

For contests, we may require only the information necessary for a child to participate, such as first name (to distinguish among family members) and parent email address (to notify the parent where required by law). We only contact the parent for more personalized information for prize-fulfillment purposes when the child wins the contest or sweepstakes.

Of course, some contests ask the child to submit their own created content along with the child’s entry. In those instances, we may require parental consent prior to submission. Please see Content Generated by a Child above for more information on our collection, notice, and consent policies.

Email Contact with a Child

On occasion, in order to respond to a question or request from a child, We may need to ask for the child’s online contact information, such as an email address. We will delete this information immediately after responding to the question or request.

In connection with certain activities or services, we may collect a child’s online contact information, such as an email address, in order to communicate with the child more than once. In such instances we will retain the child’s online contact information to honor the request and for no other purpose such as marketing. One example would be a newsletter that provides occasional updates about a site, activity, new feature or character. Whenever we collect a child’s online contact information for ongoing communications, we will simultaneously require a parent email address in order to notify the parent about the collection and use of the child’s information, as well as to provide the parent an opportunity to prevent further contact with the child. On some occasions a child may be engaged in more than one ongoing communication, and a parent may be required to “opt-out” of each communication individually.

Persistent Identifiers

When children interact with us, certain information may automatically be collected, both to make our application more interesting and useful to children and for various purposes related to our business. Examples include the type of computer operating system, the child’s IP address or mobile device identifier, the web browser, the frequency with which the child visits various parts of our sites or applications, and information regarding the online or mobile service provider. This information is collected using technologies such as cookies, flash cookies, web beacons, and other unique identifiers (which we define under the “Online Tracking Technologies” section of our general Privacy Policy). This information may be collected by Storymakery or by a third party. This data is principally used for internal purposes only, in order to:

       provide children with access to features and activities on our sites and applications

       customize content and improve our sites and applications

       conduct research and analysis to address the performance of our sites and applications

       generate anonymous reporting for use by Storymakery.

In the event we collect (or allow others to collect) such information from children on our sites and applications for other purposes, we will notify parents and obtain consent prior to such collection.

2. When Information Collected From Children Is Available To Others

In addition to those rare instances where a child’s personal information is posted publicly (after receiving high-level parental consent), we also may share or disclose personal information collected from children in a limited number of instances, including the following:

·         We may share information with our service providers if necessary for them to perform a business, professional, or technology support function for us.

·         We share shipping information with third party suppliers and distributors who help us fulfill book, poster and merchandise orders.   Third party intermediaries do not store, retain, access or otherwise use customer other than as necessary to provide you with the Storymakery Service.

·         We may disclose personal information if permitted or required by law, for example, in response to a court order or a subpoena. To the extent permitted by applicable law, we also may disclose personal information collected from children (i) in response to a law enforcement or public agency’s (including schools or children services) request; (ii) if we believe disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using our sites or applications; (iii) to protect the security or integrity of our sites, applications, and other technology, as well as the technology of our service providers; or (iv) enable us to take precautions against liability.

3. Parental Choices and Controls

At any time, parents can refuse to permit us to collect further personal information from their children in association with a particular account, and can request that we delete from our records the personal information we have collected in connection with that account. Please keep in mind that a request to delete records may lead to a termination of an account, membership, or other service.

Where a child has registered for a Storymakery.com account, we use two methods to allow parents to access, change, or delete the personally identifiable information that we have collected from their children:

1.         Parents can request access to and delete their child’s personal information by logging on to the child’s account through the My Account Page located here. Parents will need their child’s username and password. The Your Account home page explains how to recover a password if the child cannot recall it.

2.         Parents can contact Customer Services to request access to, change, or delete their child’s personal information by sending an email to us info@storymakery.com
